SMS + WhatsApp compliance

When you send a quote by SMS or WhatsApp through VoxQuote you are acting as the sender and must comply with the Spam Act 2003 (Cth). Your customer must have given you their number in the context of a genuine business transaction. Every message has a built-in unsubscribe mechanism; you may not disable or obscure it.

Cold outreach & bulk marketing — not permitted

VoxQuote is designed for customer-requested quotes and follow-up messages to tradies' existing customers. The Service is not a cold-outreach, bulk-marketing, or contact-import-and-blast tool.

You warrant that every recipient of a message you send via VoxQuote:

Importing your phone's contact list and sending commercial messages to those contacts — without one of the conditions above — is a breach of the Spam Act 2003 and the Australian Privacy Principles regardless of what consent banner any tool shows you. You cannot consent on behalf of someone else. ACMA penalties reach up to A$2.22M per day per sender.

We actively monitor send-rate patterns and will suspend any account that exceeds a reasonable per-day send cap without evidence of existing customer relationships. We cooperate with ACMA investigations and will disclose sender metadata when legally compelled.

Do Not Call Register

You are responsible for checking the Do Not Call Register before sending any marketing SMS to an AU number that hasn't requested it. Business-relationship exemptions are narrow and do not apply to lapsed customers. When in doubt, don't send.

Accessorial liability notice

Under s.16 of the Spam Act 2003, a person who procures, encourages, or induces a contravention can be held liable alongside the primary sender. We include this clause so our position is unambiguous: misuse of this Service to send unsolicited commercial messages is your liability and, where we are compelled, we will produce records showing the misuse was contrary to this policy.

Trade licensing

Many trades in Australia require state or territory licensing (e.g. electrical work, plumbing, gas fitting, building, pest control, refrigerant handling, asbestos removal). You warrant that every quote you issue is for work you are legally licensed to perform in the relevant state or territory, and that you will provide any Certificate of Electrical Safety (CoES), Compliance Certificate (CCEW) or equivalent required by law. VoxQuote does not verify licensing and is not liable for work issued outside your licence class.

WHS & Safe Work Method Statements

For high-risk construction work as defined in the model Work Health and Safety Regulations, you must prepare and follow a Safe Work Method Statement (SWMS). VoxQuote provides a SWMS drafting tool as a template only; you remain responsible for its accuracy and adequacy.

Consumer Data Right

VoxQuote is not an accredited data recipient under the Consumer Data Right regime and does not ingest banking, energy or telecommunications data from CDR sources.

Modern Slavery

We take reasonable steps to ensure our sub-processors and supply chain do not involve modern-slavery practices, consistent with the spirit of the Modern Slavery Act 2018 (Cth). A statement is available on request.

Reporting abuse

If you believe VoxQuote is being used to send spam, scams, or anything otherwise unlawful, email abuse@voxquote.com.au with the phone number or email of the sender. We respond within two business days.
